As Jyfa Magic Pen & Diamond Instinct Consult Limited operates strictly within global cross-border human resources and manpower consultancy mediation, our provisions represent intangible expert services. Consequently, physical asset returns or traditional product refunds are entirely inapplicable. All transactional engagements are governed under specialized cancellation and replacement frameworks.
2. Candidate Replacement Covenant
To secure the investments of our corporate employers and households, we maintain a strict Standard Probationary Replacement Period (typically ninety (90) days from arrival, as formalized in separate agency-client contracts) for deployed staff. A replacement protocol is activated under the following circumstances:
- The deployed worker fails local medical examinations or fitness updates required by the Sultanate of Oman.
- The candidate demonstrates absolute professional misconduct, unexcused absence, or leaves employment without valid legal reason.
- The candidate fails to meet the core performance requirements specified in the original job description.
Upon verification of these conditions, our specialized team, supervised by Founder Julius ADEOYE, will source and deliver an equivalent qualified replacement candidate at no additional agency processing cost.
3. Cancellation of Recruitment Mandates
Corporate employers or private households may cancel active sourcing requests by providing explicit written notice to our administrative desk. If cancellation occurs before visa processing or embassy mobilization steps begin, the request will be halted immediately. However, if legal data processing, immigration clearance, or airline blocks have already been secured, the client remains liable for all non-refundable expenses incurred up to the cancellation date.
4. Fee Structures & Non-Refundable Expenses
Initial retainer or processing fees paid to initiate international sourcing, candidate screening, or background evaluations are used to cover administrative costs and are non-refundable. Furthermore, payments made directly to government portals, ministry processing systems, medical check networks, or embassy visa registries are completely non-refundable, as these are controlled by external regulatory entities. Refund adjustments apply only to unallocated service fees and are processed according to contract guidelines.
5. Immigration Contingencies & Forced Delays
In scenarios where a candidate deployment fails due to unexpected entry visa rejections by the immigration office, changes in country-specific migration rules, or sudden travel embargoes, Jyfa Consult will work to shift the balance toward a substitute worker profile. Fees paid to state registries cannot be refunded or reclaimed under these sovereign force majeure conditions.
